President Trump understands the existential threat that unlimited birthright citizenship constitutes to the future well being of the United States. This makes the momentous Supreme Court decision to knock down the President’s E.O. to restrict it deeply worrying.
The Supreme Court determined 6-3 that the Birthright citizenship, based on the 14th Amendment and long-standing court interpretation, remains. So the Supreme Court is basically saying that no President can restrict a Constitutional right. Trump wanted to limit it and he has gotten his answer. He can’t.
But what does this mean? Well, Trump saw this unlimited birthright citizenship as a big driver of illegal immigration. He feels it is a loophole that encourages illegal migrants to come to the USA so their children can automatically become citizens. The President has also claimed that the current rule from the 14th Amendment is crippling the economy. Trump believes that the Constitution should be read more narrowly, so that children born to parents without citizenship or permanent residency would not automatically get US citizenship.
The Supreme Court would have none of it.
Nobody can be sure of the precise number of illegals in the States although we do know that millions came in during the Biden years. Any children from that wave can now be confident that they are American. And that is a real problem. It will change the demography of the USA and in years to come, the voting dynamic. I’ve seen some of the reaction to this decision and people are worried.
Supreme Court Justice Clarence Thomas SLAMS the decision strike down President Trump’s birthright citizenship executive order
Thomas rightly observes hat the 14th Amendment “was enacted in the wake of the Civil War with the ONE pervading purpose of securing equal citizenship for the FREED SLAVES.” He goes on to say that the Court, meaning the majority now, has repurposed the 14th Amendment to protect its own set of preferred rights that the Reconstruction Congress NEVER contemplated, and that CANNOT find support in the text today.
So just how bad is this result? Well, Trump has responded by saying that
“I guess I have to accept it. It is the Supreme Court. I think it is very bad for our nation, we are the only nation that does it.”
He’s right. The rigid application of this Amendment is deadly and of course an invite to millions of more migrants that might cross the border during a future Democrat Presidency. The roots of US destruction have been upheld by the Supreme Court.
