Well then, that was a shock! The U.S. Supreme Court has delivered a significant blow to President Donald Trump’s trade agenda, ruling by a clear 6-3 majority that he exceeded his authority by imposing broad tariffs under the International Emergency Economic Powers Act

The decision invalidates the president’s “Liberation Day” and reciprocal tariffs, which included a baseline 10% levy on nearly all imports and higher rates on countries like China, Mexico, and Canada, citing trade deficits as a national emergency.

These tariffs, implemented since early 2025, have generated over $160 billion in revenue but were challenged by Democrats as an overreach of executive power. The majority opinion, joined by Chief Justice John Roberts and five others, held that IEEPA does not authorise tariffs, leaving open the question of refunds for importers—potentially billions of dollars. This is very bad news.

However President Trump has responded swiftly and angrily during a White House press conference, calling the ruling “deeply disappointing” and a “disgrace.” He’s right. He criticised certain justices as “unpatriotic” vowing not to back down.

And then, in a defiant workaround, Trump has announced he would immediately sign an executive order imposing a new 10% “global tariff” across the board. This measure, effective at once, is temporary—lasting 150 days unless extended by Congress—and builds on existing tariffs under other authorities.

Treasury Secretary Scott Bessent stated that the shift would result in “virtually unchanged tariff revenue in 2026,” while the administration plans further investigations into unfair trade practices. Trump pledged to pursue “even stronger” policies. He is doubling down.

Of course this ruling introduces uncertainty for trading partners. Canada, Mexico, and China, previously hit with targeted much higher duties, now facing this uniform 10% rate, though potential future adjustments loom. It’s judicial chaos introduced into global trade and I can’t help but think this is a qualified win for the Democrats via a Republican Supreme Court! That should worry us all.
